Evidence of Sean “Diddy” Combs hitting his ex-girlfriend Cassie Ventura was not leaked, according to the prosecution.
The rapper’s legal team had asked for the suppression of the CCTV film showing him physically abusing his then-girlfriend at a hotel in Los Angeles in 2016.
The prosecution, however, has resisted the request this week, claiming in a statement that there is no proof they were the leak’s source. CNN, a news organization, initially released the video in May.
“As the defendant is fully aware, the video was not in the Government’s possession at the time of CNN’s publication and the Government has never, at any point, obtained the video through grand jury process,” according to the court filing.
It continued by claiming that Diddy’s legal team was “grasping at straws” and mentioning that the 54-year-old Diddy had previously been deemed “a danger regarding obstruction of justice and witness tampering” as well as “a danger to the safety of others in the community more generally” by the judge overseeing the case.
In the disputed footage, which was time-stamped in 2016, Diddy was shown dragging his then-girlfriend Cassie, who is now 38, across the floor, kicking her repeatedly, and seizing her by the neck while she lay in a hotel hallway in Los Angeles.
He is presently incarcerated at a detention facility in Brooklyn, New York, pending trial for sex trafficking and racketeering charges.
